Wherever reference is made to remote consultancy it is noted that this service is provided by Whitworth – Architects and Surveyors and the legal contract for this service is between the Client and Whitworth.
The client agrees to pay in advance for the consultation session.
The client must provide a valid contact address (if different from the subject property address), telephone number and email.
Work outside the live consultation will be charged at the rate of £150 + VAT per hour (£180 total per hour), or pro rata in ¼ hour tranches.
If a site visit is thought necessary this will be agreed at the time of the consultation and confirmation of this, the fees payable, etc will then be confirmed. The client will need to then make any appropriate additional payment for this additional service prior to the additional work being undertaken.
All payments for this service are to be made through the online booking system.
It is accepted by the client that remote consultancy will be limited by what the client shows and tells the Whitworth consultant at the time of the consultation. This remote consultation is not a substitution for a physical inspection and the nature of the consultation means the Whitworth consultant relies on the client to view matters via the client’s smartphone or tablet.
Whitworth will not accept any liability for the information, or lack of information, relayed to our consultant prior or at the time of the consultation. No liability will be accepted if the client deliberately withholds information or distorts information provided.
We accept liability only to the client and not to any third party, whether or not they are included on the video consultation.
The client (or someone with the client) must be able to access the software and be able to use their Smartphone or Tablet to enable the video consultation.
At the time of booking the appointment an outline of the matter will need to be provided. If it is something that cannot be dealt with by the Whitworth consultant the appointment will be cancelled and any payments refunded.
During the consultation if it becomes clear that the matter is something that Whitworth cannot deal with the consultation will be terminated and a refund will be made minus an administration fee of £25.
If the client needs a VAT receipt this should be requested and one will be provided.
There may be parts of the building that are inaccessible, concealed or hidden in some way and cannot be shown to the Whitworth consultant or cannot be seen in any way. Whilst guidance may be given as to what to do in terms of further investigation or opening up, no guarantee can be provided with regard to the condition of any parts of the building that are covered in such way. We accept no liability for areas that cannot be accessed.
In agreeing to this consultation, the client agrees to the session being recorded.
In the event that either Party wishes to terminate this Agreement prior to the completion of the Services, that Party will be required to provide one day’s written notice to the other Party. Late cancellations will incur the administrative fee.
Confidential information refers to any data or information relating to the business of the Client which would reasonably be considered to be proprietary to the Client
We agree that we will not disclose, divulge, reveal, report or use, for any purpose, any confidential information which has been provided during the consultation, except as authorised by the Client or as required by law.
All written and oral information and material disclosed or provided by the Client to us under this agreement is confidential information regardless of whether it was provided before or after the date of the consultation or how it was provided to us.
All intellectual property and related material (the “Intellectual Property”) that is developed or produced under this Agreement, will be the property of Whitworth.
Title, copyright, intellectual property rights and distribution rights of the Intellectual Property remain exclusively Whitworth.
Upon the expiry or termination of the consultation, we will return to the Client any property, documentation, records, or confidential information which is the property of the Client.
This Agreement will be governed by and construed in accordance with the laws of England.
